Terms of Policy
Use it for legitimate bookings. We host your page and route payments. You own your data and can leave with it. Don't use BookMySpot to break any laws or our acceptable use rules. We refund unused subscription time pro-rata.
01Acceptance
By creating a BookMySpot account or using the Services, you agree to these Terms and to our Privacy Policy. If you're agreeing on behalf of a company, you confirm you have the authority to bind it.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. We may suspend or terminate accounts that breach this section.
02The Services
BookMySpot provides hosted booking pages, scheduling, intake forms and payment processing. Payments are processed by our payment provider, Stripe, on a Stripe account connected to your organisation — card details never touch our servers.
We may add, change or remove features at any time. If a change is materially adverse to a paid plan, we'll give 30 days' notice and offer a pro-rata refund of unused subscription time.
Service availability
We work to keep the Services available around the clock, but we don't guarantee uninterrupted availability. Where practical, we announce planned maintenance in advance.
03Acceptable use
You may not use BookMySpot to:
- Sell goods or services that are illegal in the booker's or your jurisdiction.
- Process payments for prohibited verticals (firearms, gambling without licence, controlled substances, adult content, multi-level marketing).
- Attempt to bypass platform fees, structure transactions to evade tax, or facilitate money laundering.
- Send unsolicited marketing in breach of the Spam Act 2003 (Cth) or the recipient's local equivalent.
- Reverse engineer, scrape or interfere with the operation of the Services.
04Payments and fees
Subscription fees are billed in advance, monthly or annually, in the currency selected at checkout. Platform and processing fees are deducted at the time of each transaction and are visible in your Stripe dashboard.
If a chargeback or dispute arises, it is handled through your connected Stripe account under Stripe's dispute process, and Stripe's dispute fees may apply. Evidence you submit is passed to the card networks through Stripe.
Payouts
Payments settle directly into your connected Stripe account — we never hold your funds. Stripe pays out to your nominated bank account on its standard payout schedule for your country.
05Your data
You own everything you put into BookMySpot — booking records, customer details, page content. We process it as your service provider, only to operate and improve the Services, never to sell it or train third-party models.
You can export your data as CSV at any time. On account closure we delete production data within 30 days and backup data within 90 days, except where retention is required by law.
06Intellectual property
BookMySpot, the wordmark and the product UI are our intellectual property. You receive a non-exclusive, non-transferable licence to use them as part of the Services.
Anything you upload remains yours. You grant us a limited licence to host, display and process that content for the purpose of operating the Services on your behalf.
07Suspension and termination
You may cancel any time from the dashboard. Pre-paid annual subscriptions are refunded pro-rata for unused months, less any platform credit applied at signup.
We may suspend or terminate the Services for material breach, repeated chargebacks above 1% of monthly volume, or where required by a payment network or regulator. Where lawful, we'll give you 30 days to cure first.
08Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising under these Terms is capped at the fees you paid us in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law or equivalent statute in your jurisdiction.
09Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email and in-app at least 30 days before they take effect. Your continued use of the Services after the effective date constitutes acceptance.
